Subject to recommendations 2 – 4 below, that the
freehold of the former Brecon Library is transferred to the
Trustees of the Regimental Museum of the Royal Welsh for the sum
That the Regimental Museum accept a covenant to
refurbish and occupy the former Library within 2 years of
completion of the transfer.
That the use of the property is restricted to those
uses contained within Use Class D1 of the Use Classes Order 1987
An overage provision is included in the Transfer which
will be applied to any future sale of the Property within a period
of 10 years from the point of sale
enabling the Council to recover half the proceeds from any future
sale to an unconnected third party (disregarding the costs of
improvements, and grants/donations received).
To enable the
Regimental Museum to secure its presence in the town of Brecon,
given the imminent closure of Brecon Barracks in 2027 and an
appropriate use is made of this prominent listed building whilst
supporting the Council’s Vision 2025 objectives.
To ensure the Grade
2 listed former Library does not sit empty for a prolonged period
of time, given that the proposed occupier is currently operating
from another building in Brecon when under normal circumstances the
Purchasers would be continuing the existing use of the surplus
To reflect the sale
at a capital receipt lower than Market Value due to the intended
use of the building.
To ensure that the
Council is able to recover value should
the property be resold at any time within the agreed overage period
of 10 years.
