Question From: County Councillor Elwyn Vaughan Subject: Non Disclosure Agreements
Question:
How many Non Disclosure Agreements [NDAs] have Powys done in the last 3 years per year?
Minutes: Response by Head of Service:
Thank you for your question of 4 January 2024.
Powys County Council has not entered into any Non-Disclosure Agreements [NDAs] as such in the last 3 years.
However, the Council does enter into Settlement Agreements under the provisions of the Employment Rights Act 1996. The purpose of a Settlement Agreement is to settle an employee’s contractual and statutory claims on termination of employment.
Most (if not all) Settlement Agreements include a confidentiality clause, including the ACAS template for Settlement Agreements (clause 8 - see https://www.acas.org.uk/sites/default/files/inline-files/settlement-agreement-template.docx).
Thirteen Settlement Agreements have been concluded since January 2021.
