Apologies for the delay in responding. I repeat your questions for ease of reference: • Does the restoration work in this area completed thus far correlate to the latest planning permission?
The restoration work completed to date has generally been undertaken in accordance with the approved restoration scheme. Recent restoration work has however, potentially not been undertaken to levels detailed within the approved plans. This issue is currently being addressed with the site operator as part of a live planning enforcement investigation (BOC/22/0227).
• Is the restoration on schedule to be completed in time for the proposed vacation of the site at the end of October? If it is not completed to standard, what are the repercussions / how will this be enforced?
Condition 1 of planning permission 19/1899/REM requires restoration to be completed by the 30th June 2022 (note: there are some exceptions to this date). This timeframe has not been met. A planning enforcement investigation has been commenced. Dialog is ongoing between the site owner/operator and the Planning Service regarding the requirement to regularise the site. All available planning enforcement tools will be considered by the Planning Service.
• Who is responsible for monitoring flood and pollution risk over the winter when the site is vacated?
The site owner/operator is responsible for managing flood and pollution risk from the site. Enforcement of potential breaches will fall principally to Natural Resources Wales and the Local Planning Authority. Compliance with conditions relating to flood and pollution risk will be considered as part of the enforcement investigation.
• Why is the high wall not finished around the pond above Caerbont / Penrhos? - there is a high cliff edge - danger to public
This feature is part of the planning enforcement investigation. It is the responsibility of the site owner/operator to comply with Health and Safety requirements.
• Who is monitoring how water from the site is currently flowing through old coal workings into Afon Tawe.
The responsibility rests with the site owner/ operator as required by planning condition 28 of planning permission 19/1899/REM. |
