How does the Head of Service believe that approval of 156 IPUs in the last 5 years contributes to the goals of the Well-being of Future Generations Wales Act and complies with the Environment Wales Act, in particular the duties under Section 6 of the Act?

As a Local Planning Authority, legislation (the Planning and Compulsory Purchase Act 2004, Section 38.6) requires all planning applications, including those for intensive livestock units, to be determined in accordance with the development plan unless material considerations indicate otherwise. For Powys (excluding the area of the Brecon Beacons National Park), the Powys Local Development (LDP), adopted in 2018 is the relevant development that applications must be determined in accordance with. The policies in the LDP were written to take reflect the statutory duties set out in both Acts which pre-dated the LDP, and as such all planning applications made in Powys are determined in line with both Acts and the duties that they set for local authorities.
