Question from: County Councillor Kathryn Silk Subject: Looked after children
Question:
Can the Portfolio Holder tell me whether any children for whom Powys CC has parental responsibility are EU nationals and, if so, whether the County Council has taken the necessary steps for them to remain in the UK under the EU Settlement Scheme.
Minutes: Response by the Portfolio Holder:
Please see below table for details of children looked after and care leavers with EU citizenship.
Notes to table: 1. Relevant legislation: Local Authority has full care order
2. Relevant legislation: s.76 Social Services and Wellbeing (Wales) Act 2014, Interim Care Order or Placement Order
The Service has worked hard to ensure that all children for whom Powys CC has parental responsibility and are EU nationals, are able to remain in the UK under the EU Settlement Scheme.
One child has now obtained British Citizenship. One care leaver is now in the process of applying for British Citizenship. An application for British Citizenship will be made in due course, for another child for whom an EUSS application is underway.
This has not been a straightforward process. The teams have experienced difficulties navigating the legal systems of the different countries. For example, in one instance we have had to search for the father of a child in the European country to seek permission to apply, even though we have full parental responsibility.
