Application to vary a licence To consider an application to vary the licence in respect of The Lounge Café Bar, 21A High Street, Brecon. Minutes: Premises – The Lounge Café Bar, 21A High Street, Brecon Applicant – Mr Michael Lynch represented by Mr Justin Davies. Daniel Ravensec, Head Doorman Dyfed-Powys Police - Rod Bowen, Licensing Officer
The Licensing Officer presented the licensing authority’s position as outlined in the report [copy filed with the signed minutes].
In response to questions Rod Bowen advised that the applicant had worked with Dyfed-Powys Police in an open manner, was supportive of any suggestions asked of him and was always approachable. He had initially requested a fourth SIA on a Saturday when the upstairs areas was open. However Mr Lynch had presented evidence of the steps taken and as a result Rod Bowen was content with three SIAs. Although Covid procedures had been breached the applicant had been approachable and accepted his responsibilities.
Mr Davies spoke on behalf of the applicant. He advised that Mr Lynch had 21 years of experience in the trade. He stated that other premises in Brecon had licences which enabled them to operate to 3am, he noted no objections had been received from the responsible authorities, additional conditions had been accepted by the applicant, no objectors were in attendance and so it was difficult to question whether issues of noise related to the premises in question,
The Sub-Committee noted that the objector was not in attendance.
The Sub-Committee withdrew to consider, in private, the application and the evidence they had heard, with the support of the Clerk.
On their return the Chair announced their decision. In reaching the decision members took into account the relevant written and verbal representations.
RESOLVED to grant the application as submitted by the applicant subject to the conditions in the current licence and new conditions recommended by Dyfed-Powys Police: · SIA door staff to be in attendance present on Thursday, Friday, Saturday and Sunday, · CCTV footage to be available to the Police, · a Personal License holder to be on the premises from 9pm on Saturday and Sunday, · a counting device to be used from 9pm to ensure capacity is not exceeded and · no new customers to be admitted after 2am on any Thursday, Friday, Saturday and Sunday which form a Bank Holiday weekend.
The Clerk to the Sub-Committee advised that he would confirm the decision in writing.
