Minutes:

The Chair introduced the Sub-Committee and its Clerk.

 

The Clerk to the Sub-Committee on behalf of the Head of Legal and Democratic Services explained the procedures to be followed by the Sub-Committee.

To consider an application for a new premises licence from The Od Stable Block, Smith field Road, Builth Wells.

The Sub-Committee noted that four additional letters from members of the public had been received.  None of the Responsible Authorities had raised any objection to the granting of the licence.

 

The Licensing Officer presented the Licensing Authority’s position as outlined in the report [copy filed with the signed minutes].  She advised that the Licensing Section was happy with the consultation undertaken by the applicant. 

 

The Applicant outlined the nature of the premises proposed and that he did not intend allowing any persons under the age of 25 to be present on the premises except children accompanied by a responsible adult.  The objectors, like the objectors who had sent in written objections, were concerned that the peace and quiet of this semi residential area would be disturbed by noise.  The Applicant offered a number of concessions to prevent any public nuisance.

 

All parties confirmed that they had been able to make their representations.

 

The Sub-Committee withdrew to consider, in private, the application and the evidence they had heard, with the support of the Clerk. 

 

On their return, the Chair announced their decision.  In reaching the decision, members took into account the relevant written and verbal representations. 

 

RESOLVED

Reason for decision

That the application be granted subject to the standard conditions and subject to the mandatory conditions and the following:

·         Sale of alcohol - 11.30am – 23.00pm daily

·         Live Music (Indoor & outdoor) - No Licence is granted in respect of Live Music  

·         Late Night Refreshment -19.30-22.30 (Thurs/Fridays/Saturdays) 11.30-15.00 (Sunday)     

·         Outside Area – No patrons shall be allowed to remain in the outside area after 22.00 hrs

·         First Floor Flat Roof Area – No patrons shall be allowed on the first floor flat roof area except as an emergency fire escape.

In order to promote the licensing objectives.

 

The Clerk to the Sub-Committee advised that he would confirm the decision in writing and reminded parties of their right to appeal.
